  1. 1 FOIA cases are categorized as to court determination depending on whether NLRB substantially prevailed.

38 of 100 figures sit in a row or column sum that works out.

Reader’s notes

p. 169. Structure: 16 columns — stub plus five court groups (Total -- all courts, In courts of appeals, In district courts, In bankruptcy courts, In State courts), each with three columns. In each group the "Number decided" cell is a tall heading with no rule under the "Court Determination" level, so it is repeated in header levels 3 and 4; "Court Determination" spans the two determination columns of its group. The stub heading "Type of Litigation" spans all four header levels. Suspected inconsistency in the printed source (transcribed as printed, not corrected): the "Action by other parties" row shows 20 / 17 / 3 in the Total -- all courts group, but its listed sub-rows (To review: 0, To restrain NLRB from: 1, To compel NLRB to: 14) sum to only 15 decided. Relatedly, "Action by other parties" shows 2 proceedings decided in bankruptcy courts while every sub-row under it shows 0 in that group, so no sub-category accounts for the bankruptcy cases. All other cross-foots check: the grand "Totals -- all types" row equals the sum across the four individual court groups in each of the three measures; the NLRB-initiated block and its four sub-rows agree; and "To compel NLRB to:" (14 / 12 / 2) equals the sum of its four sub-rows, which confirms that "To issue decision or take specific action" is a sub-item of "To compel NLRB to:" rather than a fourth sibling under "Action by other parties". Row indentation in the original marks the hierarchy (section rows such as "To review:", "To restrain NLRB from:" and "To compel NLRB to:" carry values and are followed by indented sub-rows); indentation is not reproduced in the stub text, which keeps the printed wording, punctuation and trailing colons. The row label "To issue decision or take specific action" is printed with a wide gap (apparently a double space) between "or" and "take"; transcribed with a single space. Headings and the "Totals -- all types" / "Total -- all courts" labels use a double hyphen as printed. The superscript 1 on "(FOIA)" is a footnote marker and is written as ^1. No cells are illegible and nothing appears cut off by the crop; the caption and the footnote line are both fully visible.

p. 170. Continuation page of Table 21 (caption carries "-Continued"); the header block is reprinted in full, so all four heading levels are transcribed. 16 columns: stub plus five three-column court blocks (Number decided / Upholding Bd. position / Contrary to Bd. position). In the printed header "Number decided" and the stub heading "Type of Litigation" are tall cells spanning the lower levels, so they are repeated down those levels. Hyphenated stacked headings were rejoined ("Num-/ber de-/cided" -> "Number decided"; "Up-/hold/-ing Bd. posi-/tion" -> "Upholding Bd. position"; "Con-/trary to Bd. posi-/tion" -> "Contrary to Bd. position"). "Other" is a group line whose five indented sub-rows follow; its values are consistent with the sub-rows (5 = 2+0+3+0+0, etc.). The section symbol in "Intervention in §301 suit" is printed as a section mark, not a footnote marker. No footnotes appear on this crop; the image ends immediately below the last data row, so any notes printed under the table are outside the crop.
