  1. 1 FOIA cases are categorized regarding court determination depending on whether NLRB substantially prevailed

93 of 125 figures sit in a row or column sum that works out. 1 cell breaks a sum: 'To compel NLRB to', column 10: prints 1, rows 'Take action in C Cas' to 'Pay fees under Equal' add to 0.

Reader’s notes

p. 283. 13 columns: stub plus four three-column panels (Total—all courts, In courts of appeals, In district courts, In bankruptcy courts), each with "Number decided", "Upholding Board position", "Contrary to Board position". Suspected misprint, transcribed as printed: row "To compel NLRB to", column "In district courts / Contrary to Board position" reads 1, but its five sub-rows (Take action in C Case, Issue complaint, Take action in R case, Comply with Freedom of Information Act, Pay fees under Equal Access to Justice Act) all show 0 in that column, and the section line "Action by other parties" shows 1 there, which is already accounted for by "To restrain NLRB from" (1). The printed character is clearly a 1, not a 0; it may belong in the "Number decided"/"Upholding" pairing or be a stray. All other row and column sums in the table add up correctly. Row label "To prevent conflict between NLRA and a section 301 suite" is transcribed as printed; "suite" is almost certainly a misprint for "suit". Several zeros are lightly inked in this scan (e.g. "To review non-final orders" in the "In courts of appeals / Contrary to Board position" column prints a smudged 0); all were read as 0. Indentation of the stub is not preserved: "NLRB-initiated actions or interventions" and "Action by other parties" are top-level sections; "To enforce subpoena" through "To prevent conflict...", "To review settlement agreements", "To review non-final orders", "To restrain NLRB from", "To compel NLRB to" and the second "Other" are one level in; the rows under "To restrain NLRB from", under "To compel NLRB to", and "Objection to Board's proof of claim" are two levels in. Note there are two distinct rows labelled "Other" (one under "To restrain NLRB from", one a sub-item of "Action by other parties").
